General Terms of Use for the website
І. General provisions
1). The present Terms and Conditions constitute a Contract for the provision by Cavalieri 1981 JSC (with UIC: 207396860) of its own website www.cavalieri1981.com for the purpose of conducting distance marketing with potential buyers and users and settle the rights and obligations of the users of the website www.cavalieri1981.com, owned by Cavalieri 1981 JSC.
2). The parties to this Contract are Cavalieri 1981 JSC (UIC 207396860) on the one hand and on the other hand each user who has entered the website www.cavalieri1981.com.
3). The user states that he/she is familiar with these Terms of use and any active action or any passive behavior on his/her part after he/she enters the website www.cavalieri1981.com represents an electronic statement that he/she agrees with these Terms of Use.
4). An active action is a click/pressing/selection of an electronic link or an advertising banner on the website www.cavalieri1981.com that forwards the user to other websites.
5). A passive behavior means not leaving the website after it has loaded into the user’s browser.
ІІ. Explanation of several terms
The users state that they are familiar with and agree with the definitions of the following terms:
Web page is a combination of websites with a common home page that is loaded into your browser upon writing the e-mail: www.cavalieri1981.com;
User of a Web page or website is any person (a potential buyer of the offers offered) who has entered the e-mail address or the Web page or website through redirection from another website and, in case of interest, who makes purchases of goods and/or services by electronic means;
Interface is a combination of graphic objects associated with programming code, through which the user communicates with the website in a way that is accessible to him/her;
Platform is a combination of conceptual, software and graphical solutions, which form a complete product that provides an accessible environment to the user according to the capabilities of the Internet;
Browser is a computer program that provides opportunities for transfer, processing and visualization of data through different types of protocols for data transmission;
Electronic link is a link included in a particular Web page that allows automated forwarding to another Web page, an information resource or target through standardized protocols.
Malicious actions are actions or omissions that violate the Internet ethics and cause harm to persons connected to the Internet or associated networks. They also include: sending junk mail (unsolicited commercial communications, SPAM), gaining access to resources with someone else’s rights and passwords, use of defects in systems for the purpose of gaining benefits or obtaining information (HACK), performing actions that can be classified as industrial espionage or sabotage, damaging or destruction of systems or information arrays (CRACK), sending Trojan horses or causing installation of viruses or remote control systems, disrupting the normal operation of other Internet users and associated networks, as well as performing any actions that may qualify as a crime or administrative violation under the Bulgarian legislation or other applicable law.
Information system/System is any separate device or set of interconnected or similar devices, which provide automatic data processing upon implementation of a particular program;
Within the meaning of these Terms and Conditions Internet site means an integral and distinct part of a website;
IP Address is a unique identifier, which associates a computer, a website or a user resource in a way that allows it to be located on the global Internet network;
Password is a code of letters, numbers and characters, which together with the user name uniquely identifies the user and which provides access to his/her profile;
User name is a unique code of letters, numbers and characters, selected by the user, through which he/she is individualized in his relations with the Contractor;
User profile is a separate part of the website of Cavalieri 1981 JSC, which contains the user information required by www.cavalieri1981.com and whish is stored, used and processed therein only for the purposes of Art.4, para.1, item 3 of the Personal Data Protection Act. The user can access his/her user profile by entering a user name and a password. The user profile can also be used for communication between the user and Cavalieri 1981 JSC;
Public user profile is a separate part of the website www.cavalieri1981.com, which provides public information about the user, including name, age, date of birth, gender, permanent address and images, specific details about the purchases the user has made through Cavalieri 1981 JSC, as well as any other information about the user and his/her actions on the website of Cavalieri 1981 JSC, which is not protected by the Personal Data Protection Act;
Incidental event is a circumstance of extraordinary nature unforeseen at the time of the conclusion of the contract, which makes the provision of services objectively impossible.
Website is a separate area in the global Internet network accessible through its HTTP, HTTPS or other standardized protocols, which contains files, programs, text, sound, picture, image or other materials and resources.
Virtual portfolio is a database that provides information to the user-buyer about accumulated cash assets, conventionally called a disposable amount, which can only be used to purchase goods/services through the website www.cavalieri1981.com. At the request of the user, at a time specified by him/her and for the purchase of a product/service specified by him/her, the due amount can be deducted from the disposable amount. The disposable amount in the virtual portfolio can be adjusted at the request of the user-buyer, according to its capabilities. In this case, the relations between the user-buyer and Cavalieri 1981 JSC will be governed by a separate contract.
ІІІ. Subject matter of the Contract
1). „Cavalieri 1981” JSC provides an online shopping platform for users through its website www.cavalieri1981.com under the terms of a distance sales contract within the meaning of Art.48 et seq. of the Consumer Protection Act, by exercising the powers given to it under this Contract.
2). The distance sales contract through which the user purchases goods/services using the platform provided by Cavalieri 1981 JSC is different from the present Terms and Conditions, and by making an electronic statement for the conclusion of the purchase contract the user agrees both with these Terms and Conditions and with the content of the distance sale contract providing for an advance payment that is prominently displayed in the purchase and sale interface.
3). Cavalieri 1981 JSC will not be liable in the following cases:
- For damages caused by other websites available through links/banners placed on www.cavalieri1981.com;
- If the user leaves the account logged on to a computer or if the user authorizes and/or allows it to be used in any other way by third parties;
- For damages that have occurred in the absence or interruption of the accessibility to this website, not by fault of www.cavalieri1981.com and of the team of the same.
4). The user name, which the user uses for registration, does not give him/her any rights other than the right to use the specific user name within the information system of Cavalieri 1981 JSC. When the user changes his/her username, Cavalieri 1981 JSC does not check and does not accept any responsibility for the authenticity of the new user name, whether it affects the rights of third parties and, in particular, the right to name or other personal rights, the right to a trade name (company), trademarks or other intellectual property rights.
5). When using the electronic platform the user undertakes the obligation: to observe the Bulgarian legislation, the applicable foreign laws, the present General Terms and Conditions, the Internet ethics, the rules of morality and good manners; not to affect the reputation of others and not to call for a violent change in the constitutionally established order, crimes, violence against other people or incitement of racial, national, ethnic or religious hatred; not to preach fascist or other antidemocratic ideology; not to infringe someone else’s pecuniary or non-pecuniary rights, including intellectual property rights; to notify Cavalieri 1981 JSC immediately of any infringement committed; not to interfere with the proper operation of the system, including but not limited to: not hindering another user’s authentication process; not to use access beyond the one granted; not to harm or impede the availability, reliability or quality of the access granted and not to use it in a manner that causes it to be discarded; not to retrieve information resources or parts of information resources belonging to the databases located on the website of Cavalieri 1981 JSC by technical means or in a technical way and thus not to create its own database in electronic or other form; not to impersonate another person or otherwise mislead third persons as to his/her identity or affiliation to a particular group of people; not to perform malicious acts within the meaning of these Terms and Conditions.
6). Unless expressly agreed, the user may not reproduce, modify, delete, publish, distribute or otherwise disclose the information resources posted on the website of Cavalieri 1981 JSC.
7). By registering on the website of Cavalieri 1981 JSC, the user authorizes the establishment of a public user profile for marketing purposes, in which any information related to the user and his/her actions in the website can be provided at the discretion of Cavalieri 1981 JSC, not covered by the Personal Data Protection Act.
ІV. Personal data protection
1). Cavalieri 1981 JSC will take due care and will be responsible for the protection of user information that has become known to it regarding the registration pursuant to these General Terms and Conditions, except in cases of force majeure, incidental event or malicious actions of third parties.
2). In the registration form filled in by the user at the time of registration, Cavalieri 1981 JSC will specify the mandatory or the voluntary nature of the provision of the data and the consequences of any refusal to provide it. By agreeing to these Terms and Conditions, the user agrees that his/her information will be processed in the manner provided therein. The user profile created during the initial registration has default settings that allow free access to the user’s personal information. Upon registration, if the user wishes, he/she will have the right and technical possibility to restrict or prohibit access to his or her personal data by changing the default settings.
3). The restrictions under item 1 will not apply in case the user or persons under his/her control have committed malicious acts within the meaning of these General Terms and Conditions or have violated rights or legitimate interests of third parties. In this case, Cavalieri 1981 JSC will have the right to provide the personal information of the user to the respective competent state authorities under the current legislation.
4). Cavalieri 1981 JSC collects and uses information for users only for the purposes provided in these Terms and Conditions. The described purposes, for which the information is being used, are not exhaustively listed and do not create any obligations for Cavalieri 1981 JSC.
5). By accepting these Terms and Conditions, the user agrees to the processing of his/her personal data for the purposes of the distance sales contract for the sale of promotional merchandise by giving consent to an advance payment.
6). By accepting these Terms and Conditions, the user agrees his/her personal information that is publicly available on his/her profile at www.cavalieri1981.com, at Facebook or anywhere else in the virtual space, the information about the friends of the user in these profiles, the images or text materials uploaded in the profiles or the like, to be used and distributed by Cavalieri 1981 JSC for direct marketing purposes, unless he/she expressly prohibits the access to them. The actions of the user in www.cavalieri1981.com (liked offers, questions, comments, friends, etc.) and the information about purchased goods/service (number, price, specificity) can always be used by Cavalieri 1981 JSC for the purposes of direct marketing.
7). Cavalieri 1981 JSC undertakes the obligation not to disclose any personal information about the user or to provide the gathered information to third parties – state authorities, commercial companies, natural persons, etc., except in the following cases:
- it has received the explicit consent of the user at the time of registration or at a later date;
- the information is required by government bodies or officials who, under the current legislation, are authorized to request and collect such information in accordance with statutory procedures;
- other cases specified by the law;
8). With his/her registration in www.cavalieri1981.com, the user authorizes Cavalieri 1981 JSC or traders with offers in the website to send personal, promotional or other commercial communications to his/her user profiles in www.cavalieri1981.com, Facebook or anywhere else in the virtual space or to the e-mail address he/she has specified.
V. Clarification of the technical steps by a user-buyer on the conclusion of a distance sales contract through the website www.cavalieri1981.com
1). By uploading the home page, www.cavalieri1981.com, the user gets the opportunity to get acquainted with published offers, which in most cases relate to the purchase and/or sale of a product/service. On the home page, the user can find both the data of the company that manages the website, the General Terms and Conditions for the use of the website, as well as the General Terms and Conditions for the conclusion of a distance sales contract.
2). By actively selecting a link, banner, active button or image, the user states that he/she is familiar with the General Terms of Use of the website.
3). If the user wishes to sign a contract through the platform provided, he/she should open a specific page – part of the website, containing a specially designed interface through which the user will make an electronic statement for conclusion of a distance sales contract. In the event that the user does not have a registration on the website, he/she has to undergo a short registration procedure, during which to provide voluntarily the data necessary for the conclusion and implementation of the contract according to these General Terms and Conditions. Upon registration, the user creates a user profile with a virtual portfolio that is loaded with amounts of the user.
4). The payment of the contract price is done through manners that are exhaustively specified in the website. On the one hand the payment is a voluntary statement of the user that he/she agrees to pay for the service. On the other hand, it represents an electronic statement of the user that he/she agrees with the General Terms of Use of the website and the General Terms and Conditions of purchase and sale, which he/she has read, approved and selected up to this moment.
5). Upon conclusion of the Contract, the user will receive a message at a specified area in the user interface provided by Cavalieri 1981 JSC for his/her successfully accepted electronic statement, which confirms that the Contract has been concluded. From then on, the parties to the Contract will be governed by these Terms and Conditions.
6). Any change in the circumstances related to the Contract must be communicated to the user in the user interface provided by Cavalieri 1981 JSC. Money transfers from www.cavalieri1981.com to users of the website must be made only by bank transfer and all transaction costs incurred in connection with the amounts transferred will be at the expense of the user.
VІ. Additional conditions
1). Cavalieri 1981 JSC reserves the right to modify or supplement these General Terms unilaterally without notifying the user.
2). The user-buyer declares that he/she is aware that the services he/she purchases through the website fall within the scope of Art.50, para.3, item 2 of the Consumer Protection Act.
3). The parties declare that if any of the clauses of these Terms and Conditions prove to be invalid, this will not result in invalidity of the Contract, other clauses or parts thereof. The invalid clause will be replaced under the mandatory rules of the law or the established practice.
4). The provisions of the applicable legislation of the Republic of Bulgaria shall apply for all issues not covered by these General Terms and Conditions.
5). The promotions offered to each product are individual. Cavalieri 1981 JSC reserves the right to change the terms and conditions of the promotions.
6). Cavalieri 1981 JSC will be responsible for subsequent refunds and chargebacks with regard to credit and debit card transactions through the Allterpay online platform.
7). These Terms and Conditions may be reviewed and updated at any time by Cavalieri 1981 JSC. If you continue to use the website, you explicitly agree to any changes made.
